1.0 Introduction

These Terms and Conditions (Agreement) govern your access to and use of the Aqbay platform, products, and related services (collectively, the “Services”) provided by Aqbay (“Aqbay”, “Company”, “we”, “us”, “our”).

By accessing, registering for, or using the Services, you (“User”, “you”, or “your”) confirm that you have read, understood, and agree to the Agreement. If you do not accept these Terms, you must discontinue use of the Services immediately.

This Agreement defines the legal rights, obligations, and restrictions applicable to your use of Aqbay’s Services, including but not limited to provisions on permitted use, data handling, intellectual property, compliance responsibilities, and dispute resolution.

2.0 Legal and Compliance

Aqbay builds iGaming technology with compliance as a foundational requirement, not an afterthought. Our platforms, software modules, and original games are engineered to support operators operating in regulated, offshore, and hybrid gaming environments worldwide.

Aqbay does not function as an iGaming operator. We do not engage with players, process bets, or control gaming outcomes. Instead, we provide the underlying technical infrastructure that enables licensed or lawfully operating businesses to run their iGaming products responsibly and transparently.

Our role is limited to technology delivery, system stability, and compliance-ready tooling. All commercial operations, regulatory obligations, and player-facing activities remain entirely under the control of the operator using Aqbay’s software.

3.0 Operator Responsibility

Operating an iGaming business carries legal, regulatory, and commercial obligations that cannot be delegated to a technology provider.

Each operator using Aqbay’s technology is independently responsible for:

• Determining where their platform may be legally accessed
• Holding valid licenses or approvals required in their target markets
• Ensuring that games, payments, and promotions comply with local laws
• Managing player relationships, funds, and disputes

4.0 Jurisdiction and Access Controls

Operators are expected to configure and maintain:

• Geo-access rules to allow or restrict player entry by country or region
• Market-specific configuration for content, payments, and promotions
• Ongoing monitoring to prevent access from restricted territories

Aqbay provides the tooling to enforce these controls, but the operator makes market selection and enforcement decisions.

5.0 AML, KYC, and Responsible Gaming

Compliance capabilities available within Aqbay include:

• Player identity verification workflow and document checks
• Transaction monitoring, thresholds, and risk alerts
• Withdrawal controls linked to verification status
• Player protection tools such as limits, exclusions, and account restrictions

6.0 Licensing and Compliance Support

Aqbay does not issue gaming licenses or act as a regulatory authority.

7.0 Prohibited Use

Aqbay services may only be used for lawful and authorized gaming operations.
